Enforcement of Court judgment: Farmer Accuses Ondo Police Boss Of Misconduct 

A 72 years old farmer and an Okitipupa High Chief in Ondo State, Chief Franklin Funmi Orunto, has written petition against the State Commissioner of Police over alleged misconduct and unprofessional act. 

The petition dated February 14, was written by the lawyer to the farmer, Chief Wale Omotosho, and addressed to the Inspector-General of Police (IGP), detailing activities of the State police boss, in respect to enforcement of a court’s judgments.

It was learnt that two Ondo State High Court have delivered judgment in two suits marked HOK/23/1983 and HOK/74/2014, instituted by Chief Orunto against Omobuwa Akinmose and others and China Railway Construction Company and others, by Justice S. A. Ajayi and Justice A. O. Odusola respectively.

It was gathered that the judgments of the two Justices were not appealed till today. And that both judges granted enforcement order on the said suits.

It was also learnt that instead of the State’s Police boss to release his men for the enforcement of the orders, he in turn work against Chief Orunto by backing those who the judgments were against. 

In acknowledged copy of the petition, annexed with the Court’s judgement, made available to Newsdishng.com, Chief Orunto’s lawyer alleged that the state’s Police Command of  inciting members of the public against his client.

The lawyer alleged that the police boss collected the sum of N1.2 million from his client, being payment for mobilization of his officers to enforce a court’s judgment in favour of the farmer but failed to do so. 

The lawyer also alleged that, the action of the State’s police Command, has denied his client, Chief Orunto access to his houses both in Ondo and Okitipupa and his large expanse of farm land. 

He therefore, sought IGP intervention, to checkmate the police commissioner and direct him to enforce the courts order. 

“We humbly petition your good offices for the purposes of formally binging to your notice the recent activities of the Ondo State, Commissioner of Police, Mr. Undie Adie, which border on inciting and encouraging members of the public to attack our client and cause serious breach of the law. 

“In a matter, our client know nothing about the Commissioner of Police has been ensuring attack on our client  by some people within the state. 
“The facts of this  matter is  enforcement of court’s judgment obtained by our client which the Bailiffs in the company of the law enforcement agents, embarked upon  to execute and take    possession, as it relates to some buildings erected on the vast area of land adjudged to our client. 

“Our client was not even at the scene of the execution of the judgment but the Commissioner of Police wrongly and illegally labeled him as the person behind the public disturbance arising from different event in which the community of Okunmo attacked the Naval personnel after blocking the Igbokoda Expressway against free flow of traffic which resulted into fracas between the Naval personnel and the people of Okunmo.

“The Commissioner of Police had earlier been contacted by our client for the enforcement of this judgment, which after receiving a total sum of N1. 2 millions failed to mobilize any of his officer for the enforcement of the Judgment. 

“All necessary court’s processes that were forwarded to the commissioner, were ignored and the commissioner in spite of the money that he received from our client for logistics and other purposes, refused to carry out the execution,”, the petition read.

The farmer also alleged that the Police Commissioner in collaboration with the Soldier from 19 Battalion to back some group of people who include: Sunday Ajimuda, Olorunyo Adekoroye, Johnson Olumoye, Rev. Ranti Joseph, chief adewale kukute, Erewumi Gbenro (Gatza oil), Kalejaye Deji (Zambic), Soji Akingbuwa, Segun manegan, Kunle Ogundipe, Tobi Ogundipe, Sunday Fadeni, Akinfire Edamisan, Sylvester, Ogayemi Hendoro, Lawrence Omoranmiowo, Ayo Seja, Sunday Afuwajoye, Raphael Ajimuda and others, in ensuring that enforcement of court order became impossible.

Though, the Police Commissioner could not be reach on the allegations, however, the Police Spokesperson, Asp Tee Leo ikoro in a text message promised to meet with his boss and get back to this medium.

But as at the time of filing this report, ASP Ikoro was yet to comment on the issues.
