Family Threatens To Sue Globacom Over Mast Installation

The beneficiaries of a parcel of land sited at Olorishade Street Ahmadiya Ojokoro Lagos State, have threatened to take a legal action against an indigenous telecommunication company, Globacom limited, over its refusal to remove its mast erected on their family land.

The family in a pre-action notice to the company dated November 2, 2020 and titled ‘’Re: 1. Olorishade Street Ahmadiya Ojokoro Lagos State (Lease Agreement Lag 573)’’, signed by their lawyer, Adewale Fadipe, stated that the lease agreement dated November 25, 2015 signed with Globacom limited was for a period of five years and has expired.

The letter was written to the Managing Director, Vixen Enterprises Limited.

The family stated that several requests have been made to Globacom through its agent, either to renew the lease agreement or vacate the land, but their requests were ignored and dishonoured.

According to the letter, Globacom tool possession of the land and erected its base station and other installations as contained in the Lease Agreement 573 dated 25/11/2015 for a five years period certain.

The letter added that by virtue of the said agreement, the lease expired on the October 26, 2020.

The letter reads ‘’That by several voice, electronic communications and personal attendance at meetings in our office, your agent / employee one Mr. Segun Ariwayo undertook to forward to us your cheque in the event that you wish to seek further lease.

‘’Your agent and our client agreed on net payment of N500, 000, (five hundred thousand Naira) per annum for the period of lease sought by your company. The sum of N2, 500,000 (two million and five hundred thousand Naira only) for five year lease or N5, 000,000 (five million Naira only) for ten years cheque for either period has not yet been forwarded to us.

‘’That we have made several requests for either payment to be made as agreed or that you yield up possession through your agent/employee Segun Ariwayo but same has not been heeded owing to your several dilatory tactics’’.

‘’Take notice, therefore that should you fail, refuse or be unwilling to forward to us your bankers draft in the sum of N5,000,000, (five million Naira only) for 10 (ten years) as verbally requested by the said Mr. Segun Ariwayo, by the last working day of Monday the 9th November of 2020, we shall carry out our client’s further instruction to seek appropriate legal redress including in contract and in tort and this shall be without further warning to your good selves”.

The family lawyer, Mr. Fadipe, said since the letter was writing, Globacom Limited and it’s agent have failed to honour the letter.

Barrister Fadipe also alleged the company’s agents have vowed that they will not further pay any money while the mast and other installation on the land will not be removed.

Efforts to reach, Globalcom or its agent proved abortive, as calls and message put to one of it’s staff, Rafiu Adewale Adeyemo, whom the family lawyer claimed to be intermediary between them and the company, were not returned.
