Man Docked Over Alleged Importation, Selling of Unregistered Cosmetics

A businessman, Okonkwo Emmanuel Okakpu, was today, arraigned before a Federal High Court, Lagos, for alleged importing and selling of an unregistered cosmetics, by the National Agency for Foods and Drugs Administration Control (NAFDAC).
The businessman was arraigned before Justice Ayokunke Faji led-court, on three counts charge bordering on the offences.
The prosecutor, Mr. Umaru Shamaki, while arraigning the defendant before the court, said the defendant was arrested on December 8, 2019, after being found in possession of large consignment of  unregistered Classic Dream 24 hours Long Lasting and Classic Make-up Matte Finish Lip-Stick, at his warehouse located at APT, Article Block 9, Shop 394 Progressive Market Trade Fair, Lagos.

The prosecutor told the court that upon critical look at the cosmetics product, which he allegedly imported into the country, it was discovered that they had no expiring date.

He told the court that the offences committed by the defendant, contradict Sections 1 of Food, Drugs and Related Products (Registration, Etc) Act CAP F33 LFN 2004. And punishable under Section 6(1) (a) of the same Act. And Regulations 9(1) of Cosmetic Products (Labelling) Regulations 2005 and punishable under 10(1) (a) of the same Regulations.

The defendant pleaded not guilty to all the counts of the charge, in a charge marked FHC/L/82c/2020.
Consequently, the prosecutor, Mr. Shamaki, urged the court to remand him in the custody of the Nigerian Correctional Services (NCS) pending the determination of the charges against him.

But his lawyer, Emmanuel Ogbeche, objected to the prosecutor’s request and urged the court to admit him to bail, as the charges against him are bailable ones and in view of COVID-19 pandemic.

Ogbeche, also told the court that the defendant had been on administrative bail since the date he was arrested. He also told the court that he will undertake to produce him in court any time the matter comes up.

Following prosecutor’s admitting the that the defendant was granted administrative bail, Justice Faji, conceded to his counsel demand and the defendant was handed over to the man that stood surety for him at the NAFDAC’s office, while ordered that the conditions at which he was granted administrative bail be filed before the court with seven days, while adjourned the matter till July 2, 2020, for report of compliance with the court’s order.
