Septuagenarian, 5 Others Face Trial Over Alleged Theft of N6.4m

A 78 year-old woman, Folashade Adetoun Sofola along five others have been arraigned before a Chief Magistrate’s Court, Ogba, Lagos, over alleged theft of N6.480 million and conduct likely to breach public peace.

Others arraigned alongside Sofola are: Ime James Udofia, 48; Simon Jacob, 54; Adeyemo Adefemi, 42; Agboola Timothy Olusegun, 59 and Adejoke Omobowale Fadina, 60.

All the defendants were arraigned before Chief Magistrate Yewande Aje-Afuwa led-court, by the Force Criminal Investigation Department (ForceCID), on charges bordering on conspiracy, conduct likely to breach public peace and stealing.

The prosecutor, Mr. Nosa Watson Uhumuwango, an Assistant Superintendent of Police (ASP), had told the court that all the defendants and others now at large, on February 15, 2016, at about 12.46 noon, at 12, Oyetubo Street, off Obafemi Awolowo way, Ikeja, Lagos, conspired among themselves to commit the alleged offences.

The prosecutor also told the court that all the defendants, on the said date, time and place, stole building materials valued N3.548 million and cash sum of N2.860 million, properties of one Comrade Nelson Elekima

He also told the court that the defendants also conspired among themselves and acted in a conduct likely to breach the public by forcibly entry into the above stated address and chased away those working in the place.

The offences according to the prosecutor said the alleged offences contravened sections 409; 185; 52; 166(d) and 363 of the Criminal Laws of Lagos State, 2011.

All the defendants had pleaded not guilty to the offences.

Chief Magistrate Aje Afuwa, after hearing from the prosecutor, Mr. Nosa, on august 21, 2020, informed parties that further hearing date would be communicated.

Count one of the charges read: “that you Folashade Adetoun Sofola; Ime James Udofia;  Simon Jacob; Adeyemo Adefemi; Agboola Timothy Olusegun and Adejoke Omobowale Fadina and others at large, sometimes in the month of February, 2016 II No 12. Oyetubo Street, off Obafemi Awolowo Way, Ikeja, in the Lagos Magisterial District, did conspired among yourselves to commit Felony to wit: stealing and thereby committed an offence punishable under Section 409 at the Criminal Law of Lagos state, 2011.

Count two reads: “that you Folashade Adetoun Adetoun Sofola; Ime James Udofia; Simon Jacob; Adeyemo Adefemi; Agboola Timothy Olusegun and Adejoke Omobowale Fadina and others at large, on the same date, time and place in the aforesaid Magisterial District, did steal building materials valued N3, 548,000.00 (Three Million Fave Hundred And Forty Eight,Thousand Naira) and cash sum of N2, 860, 000.00 (Two Million Eight Hundred and Sixty Thousand Naira) property of one Comrade Nelson Elekima, ‘M and thereby command an offence punishable under Section 185 of the Criminal Law of Lagos State,  2011.

Count four: “That you, Folasade Adetoun Solola, Ime James Udofia; Simon Jacob; Adeyemi Olufemi; Agboola Timothy Olusegun and Adejoke Omobowale Fadina and others at large, at No. 12, Oyetubo Street, Off Obafemi Awolowo Way Ikeja, Lagos, In the Lagos Magisterial District. forcefully entered into the above mentioned address which Is In peaceable possession of one Comrade Nelson Elekina and thereby committed an offence punishable under section 52 of the Criminal Law of Lagos State, 2011.
