2 Men Docked For Unlawful Dealing In 105.8kg of Indian Hemps

Two men, Joseph Shola, 25 and Bashir Ali Mohammed, 41, were today, arraigned before a Lagos Federal High Court, by the men of National Drug Laws Enforcement Agency (NDLEA), for allegedly deal in 105.8 kilogrammes of Cannabis sativa, popularly known as Indian Hemps.

The two men were arraigned on a count each of the offence, which the prosecutor, Mr. Jerry Aernan, said is contrary to and punishable under Section S. 11(c) of the. National Drug Law Enforcement Agency Act Cap. N30 Laws of ‘the Federation of Nigeria, 2004. 

Arraigning the two defendants, Mr. Aernan, to the court that Joseph was arrested on June 20, 2021, at General Paints, Ajah, Lagos, with 74.2 kilograms of the substance. While also told the court that Bashir was arrested on June 3, 2021, at 4, Vincent Street, Lagos Island, with 31.6 kilograms of the prohibited weed.

Upon the reading of the charges to the two men, they pleaded not guilty.

Followng their not guilty plea, the prosecutor, Mr. Aernan, urged the court to remand them in the custody of the Nigerian Correctional Services (NCoS), till the determination of the charges against them.

But their counsel, A. Worrey, informed the court of his clients bail applications, which he said have been served on the prosecution. He therefore pleaded with the court to admit them to bail in liberal terms.

Ruling of the bail applications, Justice Tijjani Ringim, admitted bail to Joseph in the sum of N10 million, while granted bail to Bashir in the sum of N5 million.

Apart from bail sums, the judge also ordered the defendants among other conditions, to produce two sureties each, which one of them must be a Grade Level 14 officer in either Federal or Lagos State government establishment, while the second surety must be a landed property owners with the court jurisdiction.

The judge however remitted their case file to the Admin Judge, for further reassignment for their trial.

Charges against the defendants are
“That you, Joseph Shola, Male, Adult, 25 years old on or about the 20th day of June, 2021 at General Paints, Ajah, Lagos, State within the.jurisdiction of this Honourable Court without. lawful authority, dealt in 74.2 kilogrammes of Cannabis sativa, a narcotic drug similar to Cocaine, Heroin and LSD and thereby committed an offence contrary to and punishable under S. 11(c) of the National Drug Law Enforcement Agency Act Cap. N30 Laws of ‘the Federation of Nigeria, 2004”. 

“That you Bashir Ali Mohammed, male, adult, 41 years old on or about the 3rd day of July, 2021 at No. 4 Vincent Street, Lagos Island Lagos within the jurisdiction of this Honourable court without lawful authority dealt in 31.6kg of Cannabis Sativa a narcotic drug similar to Cocaine, Heroin and LSD and thereby committed an offence contrary to and punishable under S. 11 (c) of 
the National Drug Law Enforcement Agency Act Cap. N30 Laws of the Federation of Nigeria, 2004″.
