Ogun 2023: A’Court Nullifies ‘Ladi Adebutu’s Candidacy
An Abuja division of Appeal Court, today, set aside an earlier judgment of an Abuja division of the Federal High Court in favour of the Peoples Democratic Party (PDP) governorship candidate in Ogun State, Oladipupo Adebutu.
A three-member panel of the Appeal Court, in a ruling on Friday, faulted the judgment of Justice Taiwo Taiwo (now retired) in which declined jurisdiction to entertain a suit filed by Jimi Adebisi Lawal.
Lawal had challenged the PDP’s utilisation of a delegates’ list as against the list of delegates who were elected at the ward congresses for the conduct of the May 25, 2022, governorship primary election.
But Justice Biobele Georgewill, in lead judgement today, ruled that the Federal High Court has jurisdiction over the case as it is pre-election related.
The judge also orders remitting the case to the Chief Judge of the Federal High Court for the hearing of the case on merit.
It would be recalled that an Abeokuta Federal High Court, presided by Justice Oluremi Oguntoyinbo, had on last week voided Adebutu’s candidacy in another suit filed by another aspirant of the party.
